Liability Disclaimer for Suspension/Ban (Ban)

Critical Warning
Explicit and Binding Acknowledgment: By using the Risaltna platform, you expressly and irrevocably acknowledge and agree that the platform, its owners, and its operators are not liable whatsoever for any suspension (Ban), stop, restriction, reduced reach, or closure affecting any number/account/device/IP address — for any reason, whether known or unknown, direct or indirect.

This disclaimer includes — without limitation:

  • Temporary or permanent suspension of numbers.
  • Messaging restrictions, reduced reach, or limits imposed by the service provider.
  • Policy, system, or algorithm changes by any third party.
  • Network errors, outages, updates, or failures beyond the platform's control.
  • Suspensions occurring even when the user complies with sending limits or without a clear reason.
No Warranties: The service is provided "as is" and "as available", and we make no express or implied warranty that there will be no suspension/ban, or that any third-party integration will remain available or uninterrupted.

Limitation of Liability + Indemnification (Indemnification)

Binding

1) Limitation of Liability

  • The platform shall not be liable for any loss of profits, loss of customers, loss of goodwill/reputation, or any indirect, incidental, special, or consequential damages.
  • Any liability (if legally established) — if any — shall be limited and capped at an amount not exceeding the subscription fees paid during the last 30 days.
  • The platform shall not be liable for any damages resulting from: misuse, user content, or violation of laws or the policies of service providers.

2) Indemnification Clause

  • The user agrees to indemnify and hold harmless the platform, its owners, employees, and partners from and against any claims/complaints/lawsuits/fines/losses arising out of the user's use of the platform.
  • The indemnity includes any legal costs, damages, or attorneys' fees related to the user's conduct, content, or messages.
Our Objective: To provide a stable and secure platform — however, full responsibility for campaigns, content, and compliance remains with the user.

Acceptable Use Policy (Anti-Spam)

Protection

Use of the platform is prohibited in any of the following cases:

  • Sending spam, random bulk messages, or causing disturbance to users.
  • Fraudulent messages, phishing, impersonation, or malicious links.
  • Sending content that violates laws or regulations (defamation, threats, hate speech, illegal materials).
  • Contacting parties without prior consent where required (Opt-in).
  • Ignoring Opt-out/unsubscribe requests or continuing communication after a complaint.
Immediate Action: We reserve the right to restrict messaging, suspend the account, or close it upon suspected misuse or upon receipt of substantiated complaints.

General Terms and Conditions

Use

1) Definitions

  • Platform: Risaltna, its services, dashboards, and API interfaces.
  • User: Any individual/entity that uses the service or creates an account.
  • Third Party: Any external service provider (platforms, hosting, networks, etc.).

2) Account and Security

  • You are responsible for safeguarding your login credentials and API keys and must not share them.
  • Any activity conducted through your account shall be deemed to have been performed by you, and you bear full responsibility for it.

3) Fees and Subscriptions

  • Features may be activated based on the selected plan/subscription.
  • Prices or packages may change with prior notice when required.

4) Modifications

  • This document may be updated from time to time. Your continued use of the service constitutes acceptance of such updates.

Privacy Policy

Data

1) What data do we collect?

  • Account data: name/email/phone (as provided by you).
  • Operational data: technical usage logs (request times, errors, security information such as IP).
  • Data you upload: contacts/groups/message content based on product features.
  • API keys: displayed in a masked form where possible and stored with appropriate security measures.

2) Why do we use the data?

  • To operate the service and provide its features.
  • For security and prevention of misuse.
  • To improve performance and resolve issues.

3) Data Sharing

  • We do not sell your data.
  • Only the minimum necessary data may be shared with technical service providers to operate the platform.
  • Data may be disclosed where required by applicable law or a binding order issued by a competent authority.

4) Security

  • We implement reasonable security measures (access controls, monitoring, and security safeguards).
  • However, no system can guarantee 100% security against all technical risks.
